1. Information about the prizes and how to enter forms part of these Terms and Conditions for the eBay Southeast Asia “Improve Your DSR” Promotion (Promotion). Entry into the Promotion is deemed acceptance of these Terms and Conditions. Entries not in accordance with these Terms and Conditions are ineligible.

2. Entry is open to all persons resident in Singapore, Malaysia, Philippines or Thailand, over the age of 18 years. Employees of the Promoter or the Sponsor (as defined in clause 31) or their associated companies, suppliers, distributors, agents and their immediate family members, and persons whose account with eBay have been temporarily or indefinitely suspended or made inactive by the Promoter at the end of the Promotion Period (as defined in clause 7), are not eligible to enter the Promotion.

3. Those who enter into and participate in this Promotion (Participants) are responsible for ensuring that all their contact details registered with or submitted to the Promoter are correct. Participants will forfeit their right to claim the Prize (as defined in clause 16) or the Discount (as defined in clause 20) in the event that their contact details are inaccurate or wrong. Participants may check or update their contact information with eBay by visiting the Personal Information section of “My eBay” at their local eBay site. |

4. To qualify for entry into this Promotion, you must, at the time of entry:
 |

(a) |
be validly registered as a member of any eBay website (including but not limited to http://www.ebay.com) in accordance with all applicable terms and conditions, policies and your User Agreement with eBay as may be applicable to such eBay website (namely, you must have a valid “eBay User ID”), and the country of residence as registered under your eBay account must be either Singapore, Malaysia, Philippines or Thailand; and |

(b) |
have Detailed Seller Ratings (DSR Scores) from at least ten (10) transactions in your seller profile from July 25, 2008 to August 25, 2008. |

5. In addition, if at the end of the Promotion Period you have been suspended as an eBay user, you will be disqualified from the Promotion and you will not be eligible to win any Prize or Discount.

6. To enter into this Promotion, before 23:59:59 Singapore Time, i.e. GMT + 8 hours (SGT) on 14 September 2008, all you have to do is simply visit the microsite at http://www.ebay.com.sg/sea/improveyourdsr (Promotion Microsite) and register for the Promotion using your eBay User ID.

7. This Promotion commences at 00:00:01 SGT on August 25, 2008 and closes on 23:59:59 SGT on September 30, 2008 (Promotion Period).

8. Upon your registration as a Participant, the Promoter will measure your DSR Scores on all four (4) areas (Areas), namely: (a) “Item As Described”; (b) “Communication”; (c) “Postage Time” (also known as “Shipping Time” on some eBay sites); and (d) “Postage & Handling Charges” (also known as “Shipping & Handling Charges” on some eBay sites). |

9. The Promotion shall consist of two (2) contest categories (Contests), namely:

(a) |
Most improved DSR Score for Postage Time (1st Contest); and
|
 |
| |
(b) |
Most improved DSR Score for Postage & Handling Charges (2nd Contest);
as well as one (1) bonus promotion (Bonus Promotion), namely
|

| |
(c) |
Overall DSR Score maintenance and improvement.
|
|
|
| |
10. Entry into all the Contests and the Bonus Promotion is automatic upon entering the Promotion. However, the Promoter will assess your eligibility to enter the specific Contests based on the date and time that you register on the Promotion Microsite and whether that falls within the 1st Contest Period (as defined in clause 11.1) or the 2nd Contest Period (as defined in clause 11.2). For example and for illustration purposes only, if you register on 3 September 2008 this falls within the 1st Contest Period and therefore you will eligible to enter into both the 1st Contest and 2nd Contest; however if you register on 12 September 2008 this falls within the 2nd Contest Period only and therefore you will be eligible to enter into only the 2nd Contest. In both scenarios you will be entitled to enter into the Bonus Promotion.

11. The mechanics of the Promotion (Mechanics) are as follows:

The Contest Period for the 1st Contest shall be from 00:00:01 SGT on August 25, 2008 to 23:59:59 SGT on September 5, 2008 (1st Contest Period). |

11.1.2 |
The Participants will be competing to achieve the largest improvement in their Postage Time DSR Scores by comparing such DSR Scores taken from and averaged out over the 30-day period prior to the end of the 1st Contest Period to the DSR Scores taken from and averaged out over the 30-day period prior to the commencement of the 1st Contest Period. |

11.2 |
Most Improved DSR Score for Postage & Handling Charges

11.2.1 |
The Contest Period for the 1st Contest shall be from 00:00:01 SGT on September 6, 2008 to 23:59:59 SGT on September 19, 2008 (2nd Contest Period)

| |
11.2.2 |
The Participants will be competing to achieve the largest improvement in their Postage & Handling Charges DSR Scores by comparing such DSR Scores taken from and averaged out over the 30-day period prior to the end of the 1st Contest Period to the DSR Scores taken from and averaged out over the 30-day period prior to the commencement of the 2nd Contest Period.

11.3 |
Overall DSR Score maintenance and improvement |

11.3.1 |
For the Bonus Promotion, Participants whose DSR Scores (taken from and averaged out over the 30-day period prior to the commencement of the Promotion Period) are below 4.7 on any given Areas must improve their average DSR Scores such that their DSR Scores on all four (4) Areas at the end of the Promotion Period are 4.7 or greater. Participants whose DSR Scores (taken from and averaged out over the 30-day period prior to the commencement of the Promotion Period) are at least 4.7 on all four (4) Areas must maintain or improve on the existing level of their DSR Scores such that at the end of the Promotion Period, their DSR Scores averaged out over the past 30-day period on all four (4) Areas remain at least 4.7.

12. For the 1st Contest there will be one (1) winner (Winner). The Winner will be the one among the eligible Participants of the Promotion who has the best performance in the 1st Contest, in accordance with the respective Mechanics of that Contest as set out in clause 11.1. |

13. For the 2nd Contest there will be one (1) Winner. The Winner will be the one among the eligible Participants of the Promotion who has the best performance in the 2nd Contest, in accordance with the respective Mechanics of that Contest as set out in clause 11.2.
|

14. For the Bonus Promotion the number of Winners is unlimited. The Winners of the Bonus Promotion will be those eligible Participants who manage to meet the criteria with respect to the improvement or maintenance of their DSR Scores as the case may be, in accordance with the Mechanics of the Bonus Promotion as set out in clause 11.3.

15. The Winners shall be determined by the Promoter in its sole and absolute discretion.
|
|

| |
16. The prizes that the Winners of each of the respective Contests shall be entitled to receive (Prizes) will be one (1) Sony DSC W55 Digital Camera for each Contest respectively.
|
|
| |
|
|
| |
17. The Prizes will be sent to the respective Winners by registered post within 60 days of the end of the Promotion Period.
|
|
| |
|
|
| |
18. The Promoter retains the right to substitute each Prize with a prize of equal or greater value, subject to any approvals necessary.
|
|
| |
|
|
| |
19. While the Promoter will use reasonable efforts with regard to the packaging of the Prizes for shipping, the Promoter shall not be held liable for the loss or damage of any of the Prizes in the course of shipping. The Promoter will not be using shipping insurance when shipping the Prizes.
|
|

|
|
| |
20. The Winners of the Bonus Promotion shall be entitled to receive a 50% discount in listing (insertion) fees for a five (5) day consecutive period for listing items on http://www.ebay.com some time during the month of October 2008 (Discount). The details of the Discount and how and when it may be redeemed will be sent via email to the Winners.

21. No costs or expenses, other than those expressly set out in these Terms and Conditions will be included in the Prizes or the entitlement to the Discount and all costs and expenses relating to or arising out of the receipt, redemption and/or use of the Prizes or the Discount, other than those expressly included in these Terms and Conditions, are the responsibility of the Winner.

22. The Prizes and the Discount are not transferable or exchangeable.

23. The Promoter or its authorized representatives will notify:
 |
| |
(a) |
the Winners of the Contests within 14 days of the end of the Promotion Period by the telephone number listed in their eBay registration details (if possible) or by email (to the email address as stated in the Winners’ eBay registration details); and
|
 |
| |
(b) |
the Winners of the Bonus Promotion only when they receive the actual email notification of their eligibility regarding the Discount.
|
|
|

|

| |
24. Within 30 days of the end of the Promotion Period, for the Winners of the Contests, each such Winner’s first initial, surname and truncated form of username (e.g. a**b) will also be published on the announcement board of http://www.ebay.com.sg.
|

| |
25. All entries are the property of the Promoter. All personal information will be held and dealt with in accordance with the Privacy Policy of the Promoter which is available on the eBay website (http://pages.ebay.com.sg/help/policies/privacy-policy.html).

| |
26. If in the Promoter’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Promotion, or if computer viruses, bugs, unauthorised intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of this Promotion, or if for any reason this Promotion is not capable of running as planned, the Promoter reserves the right at its sole discretion to disqualify any individual who tampers with the Promotion, to modify this Promotion (including the Prizes and these Terms and Conditions), or to terminate this Promotion, subject to approval from any relevant regulatory authorities where applicable.

27. The Promoter’s decisions made in respect of this Promotion are final, and no correspondence will be entered into, including in the event of a dispute.
|

28. The Promoter is not liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with participating in this Promotion or receiving, taking or using the Prizes, except for death or personal injury arising out of the Promoter’s negligence or willful actions, or fraud, or any liability which cannot be excluded by law. Any tax liability arising as a result of receiving, taking or using the Prizes is the responsibility of the Winner.

29. Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for entries not received or the receipt of incorrect, inaccurate or incomplete information caused by a Participant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, lines, servers, telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to Participants or any other person's handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.

30. These Terms and Conditions will be interpreted, construed and enforced in all aspects in accordance with the laws of Singapore, and all Participants hereby submit to the non-exclusive jurisdiction of the courts of Singapore. This Promotion shall be deemed void if it is not permitted or otherwise prohibited by law in the jurisdiction of the Participant, and Participants shall be responsible for ensuring that their participation complies with the local laws of their jurisdiction.
